In many cases, the two processes complement one another. A dispute may begin in arbitration but be successfully resolved through mediation before a final hearing takes place.
Arbitration
Arbitration is a private alternative to court proceedings in which an independent arbitrator or tribunal determines the dispute.
It is commonly used in international commercial contracts because it offers confidentiality, procedural flexibility and the ability to appoint decision-makers with experience of the relevant industry or legal issues.
